What is Wrongful Death?

Wrongful Death occurs when an individual is fatally injured (car accident, etc.) because of the misconduct or the negligence of another person, company or entity.

Who can file a claim?

Intermediate family members such as parents, spouses and children usually can file a claim. Other family members like grandparents, step-parents and dependents may in some cases file a claim.

1. How much is my case worth?

This is a difficult question to answer and depends on many factors, including the law in the state where the injury occurred (some states have caps on the amount of money damages that can be awarded). Other factors include how significant the damages are, how likely it is that our client will win the case, and what injuries the client suffered as a result of the Defendant's wrongdoing. Also, a case is never worth more than the Defendant can pay.

2. How long does the case take?

Each jurisdiction is different, but it is more common for a case to take a few years than it is to take a few months.

3. How much money will it take to pursue my case, and who pays these costs?

In almost all our cases, Gower Law PLC agrees to front the expense of pursuing a claim. Personal injury and malpractice cases can be very expensive. Money is generally spent on expert testimony, purchasing medical records, paying filing fees and buying deposition transcripts of the witnesses who are interviewed under oath during the lawsuit. We understand that most individuals do not have the monetary resources to invest in a lawsuit, which is why we almost always take care of the costs.

4. How do the lawyers get paid?

We work on a contingent-fee basis, taking a percentage of the amount recovered to pay our fee. Remember: we never get paid unless you get paid.
